DIFFERENCE BETWEEN BROKERS AND SALESPERSONS LICENSES

Two types of licenses are issued by the Nebraska Real Estate Commission to individuals operating in the real estate business.

SALESPERSON'S LICENSE

With this type of license, the licensee is permitted to engage in all phases of the real estate business, if employed by and under the direct supervision of a licensed broker at all times.

BROKER'S LICENSE

With this type of license, the licensee is permitted to engage in all phases of the real estate business either independently, as a self-employed broker, or as an associate broker employed by and under the direct supervision of a licensed broker at all times.

GENERAL SALESPERSON/BROKER LICENSE REQUIREMENTS

If you are interested in obtaining a resident Nebraska Real Estate License, you must meet the minimum requirements below:

  • All applicants must be 19 years old prior to taking the examination
  • All applicants must be high school graduates, hold a certificate of equivalency, or evidence of participation or enrollment in a home school program from the Department of Education.
  • CURRENT REQUIREMENT-96 HOURS TOTAL
    • 90 clock hours (3 course) in Approved Pre-License Education to include:
      • 30 Hour Course in Real Estate Principles and Practices
      • 30 Hour Course in Nebraska Real Estate License Law
      • 30 Hour Course in an Approved Pre-License Education Course
    • 6 Hour Professional Practice Standards (Course #0003)
  • All applicants for original licensure as a real estate salesperson or broker to must undergo a criminal background check utilizing fingerprints. *
  • Approval of Application
  • Examination score of 75%
Associate Broker/Broker 2 Years**
  • All applicants must be 19 years old prior to taking the examination
  • All applicants must be high school graduates, hold a certificate of equivalency, or evidence of participation or enrollment in a home school program from the Department of Education.
  • CURRENT REQUIREMENT
    • 60 clock hours (2 courses) in Pre-License Education in addition to the hours required for a salesperson license.  May not repeat the courses taken for a salesperson license.
    • 6 Hour Professional Practice Standards (Course #0003) if not taken within the last 4 years.
  • 2 years of full-time Salesperson Experience or part-time equivalent***
  • All applicants for original licensure as a real estate salesperson or broker to must undergo a criminal background check utilizing fingerprints. *
  • Approval of Application
  • Examination score of 75%

If you have you ever been convicted of any misdemeanor or felony offenses, or if there any such charge pending against you you must provide: full details including dates, places, disposition, and a detailed explanation of the events leading up to the charge(s), etc. Note: You MUST include any pending charges; Convictions, no matter how old, must be reported, even though there may have been an order or note by the court to expunge, set aside, or strike the conviction from the record. 

  • If you do not disclose all convictions, your application may be denied.  We will compare your application to the criminal background report and the justice system search.  You may purchase these reports prior to submitting your application if desired.

The words "have first served actively for two years" means that the applicant must have worked full-time at activities which require a salesperson's or broker's license, or, if less than full-time, for a period of time equal to two years of full-time activities. An investigation will be made by the Commission to determine the applicant's level of activity. The experience requirement must be fulfilled by the time of the examination.

The Commission determines the full time experience from two sources and averages the hours together to ensure two-years of full-time Salesperson experience or part-time equivalent.

  • The Commission will send a broker survey to your prior designated brokers upon submission of the application.
  • The Commission will review prior salespersons renewals submitted by the applicant.

If an applicant does not have two (2) years of active salesperson experience, the law provides that they may complete a special application and attend an informal hearing before the commission to see if they may be granted a brokers license if hardship is proven. 

The applicant must complete and submit the following:

  • Special Hardship Application Form
  • Satisfactory evidence of hardship due to an existing brokerage being unable to retain the services of a licensee to act as its designated broker who has the two years' experience required.

If the applicant has been approved at the hearing they must complete the following:

  • One of the following education requirements must be completed:
    • Furnish a certificate that he or she has passed a course of at least eighteen credit hours in subjects related to real estate at an accredited university or college,
    • Completed six courses (180 hours) in approved real estate prelicense education courses.
  • Furnish evidence of completion of six (6) class hours of study in a course approved by the Commission related to professional practice and standards. Course Number 6000
  • Applicants must take and pass the Broker’s examination.

Upon Passing the Examination the applicant must complete the following:

  • Must be licensed as a designated broker
  • Complete the 12 hour post license course within 180 days of licensure – Course Number 7000
  • The Commission may extend the designated broker post licensure education, Course Number 6000, 4 courses (12 hours), in the subjects of real estate trust accounting, brokerage finance, business ethics, and risk management, for up to six months, under the hardship provision
  • All other license requirements apply upon license issuance.

How to Apply for a License 

If you are a military service member, veteran or spouse, we have procedures in place to expedite and assist you in applying for a license with NREC.  

  1. Review the qualifications and requirements for Persons Moving to Nebraska Who Presently Hold a Real Estate License in Their Resident Jurisdiction.
  2. Complete an application for the type of license you currently have in your resident jurisdiction

  3. You must comply with the fingerprinting requirements.
  4. Fill out and submit the Supplemental License Issuance Form for Military Service Members and Military Spouses
  5. We will waive the license issuance fee if:
    1. servicemember is assigned to a permanent duty station in Nebraska AND
    2. The applicant is already duly licensed in another regulatory jurisdiction ; or
    3. you held this license in Nebraska within the last three years
       

Other Ways NREC Can Help Military Service Members and Military Spouses: 

  • Nebraska residents who enter military service and resume their Nebraska residence immediately upon separation from the military have not lost their Nebraska residency unless they have established legal residence elsewhere.
  • NREC may also be able to issue a license to licensees who have not renewed for up to three years after being called to active military service.  See Title 299-Chapter 1, Sec. 010 for further information.
